THE PRIVACY POLICY DESCRIBES THE PRINCIPLES OF HOW WE PROCESS INFORMATION ABOUT YOU, INCLUDING PERSONAL DATA AND COOKIES.

4. The operator is the Administrator of your personal data in relation to the data voluntarily provided on the website.
5. The website uses personal data for the following purposes:

• Handling inquiries via the form
• Preparation, packaging, and shipment of goods
• Fulfillment of ordered services
• Presentation of offers or information

6. The website collects information about users and their behavior in the following ways:

• Through voluntarily entered data in forms, which are then stored in the operator’s systems.
• By saving cookies (so-called “cookies”) on users’ devices.

2. SELECTED DATA PROTECTION METHODS USED BY THE OPERATOR

1. Login and personal data entry areas are protected during transmission (SSL certificate). This ensures that personal data and login information entered on the website are encrypted on the user’s computer and can only be read on the destination server.
2. An important element of data protection is the regular updating of all software used by the Operator to process personal data, which specifically means regular updates of software components.

4. YOUR RIGHTS AND ADDITIONAL INFORMATION ON HOW DATA IS USED

1. In some situations, the Administrator has the right to transfer your personal data to other recipients if it is necessary to perform the contract concluded with you or to fulfill the obligations imposed on the Administrator. This applies to the following groups of recipients:

• Couriers
• Postal operators
• Payment operators
• Comment system operators
• Authorized employees and collaborators who use the data for the purpose of operating the website
• Companies providing marketing services for the Administrator

2. Your personal data processed by the Administrator will not be kept longer than necessary to perform the activities related to them, as defined by separate regulations (e.g., accounting regulations). Regarding marketing data, the data will not be processed for more than 3 years.

• Restriction of processing

4. You have the right to object to the processing referred to in point 3.3 c) regarding the processing of personal data for the purpose of pursuing the legitimate interests of the Administrator, including profiling. However, the right to object cannot be exercised if there are important legally justified grounds for processing, overriding your interests, rights, and freedoms, particularly for the establishment, exercise, or defense of claims.
5. You have the right to file a complaint regarding the Administrator’s actions with the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw.
6. Providing personal data is voluntary but necessary for the operation of the website.
7. Automated decision-making processes, including profiling, may be carried out in relation to you in order to provide services under the concluded contract and for the purpose of direct marketing by the Administrator.
8. Personal data is not transferred to third countries as defined by personal data protection regulations. This means that we do not send it outside the European Union.

5. INFORMATION IN FORMS

1. The website collects information voluntarily provided by the user, including personal data, if provided.
2. The website may record information about connection parameters (such as timestamp, IP address).
3. In some cases, the website may save information that helps link data in the form with the user’s email address. In such cases, the user’s email address appears within the URL of the page containing the form.
4. The data provided in the form is processed for the purpose arising from the specific function of the form, such as processing a service request, business contact, service registration, etc. The context and description of the form clearly indicate its purpose.

6. ADMINISTRATOR’S LOGS

1. Information about users’ behavior on the website may be logged. These data are used for the purpose of administering the website.

7. IMPORTANT MARKETING TECHNIQUES

1. The operator uses statistical analysis of website traffic through Google Analytics (Google LLC, based in the USA). The operator does not send personal data to the service provider, only anonymized information. The service relies on the use of cookies on the user’s device. Regarding information about user preferences collected by the Google ad network, users can view and edit cookie-related information using the tool: https://www.google.com/ads/preferences/
2. The operator uses remarketing techniques, which allow for the customization of advertising messages based on the user’s behavior on the website. This may create the illusion that the user’s personal data is being used for tracking, but in practice, no personal data is transferred from the operator to advertising providers (exception: enhanced conversions described in item 5 below). The technological condition for such activities is that cookies are enabled.
3. The operator also uses the Meta pixel (formerly Facebook pixel). This technology causes Meta (Meta Inc., based in the USA) to know that a registered user has visited the website. It is based on data for which Meta is the administrator. The operator does not transfer any additional personal data to Meta (Facebook). The service relies on the use of cookies on the user’s device.
4. The operator uses Microsoft Clarity (Microsoft Corporation, based in the USA) to analyse how users use the website and the neon creator: the tool records mouse movements, clicks and scrolling (session recordings) and creates click maps. On the whole website Clarity runs only after consent to statistics cookies – it then sets the cookies _clck (Clarity user ID, up to 1 year) and _clsk (links page views into one session, up to 1 day). On the neon creator page Clarity also runs without this consent, but then it sets no cookies and the page content and entered data are masked before being sent to Microsoft. The legal basis for processing is: after consent – consent (Art. 6(1)(a) GDPR); in the neon creator without consent – the controller’s legitimate interest, namely analysing and improving how the creator works (Art. 6(1)(f) GDPR), with content masked and without cookies. 5. The operator uses Google Ads enhanced conversions (Google Ireland Limited). When you send an enquiry through a form on the website or in the neon creator, the contact details given in the enquiry (e-mail address, phone number) are sent to Google Ads in encrypted form (SHA-256 hash), solely to measure the effectiveness of advertising. The legal basis is the operator’s legitimate interest (Art. 6(1)(f) GDPR), i.e. measuring the effectiveness of advertising campaigns. 8. INFORMATION ABOUT COOKIES

1. The website uses cookies.
2. Cookies (so-called “cookies”) are data files, primarily text files, stored on the end device of the User of the website and are intended for use with the website’s pages. Cookies usually contain the name of the website from which they originate, the time they are stored on the end device, and a unique number.
3. The entity placing cookies on the end device of the User and accessing them is the website operator.
4. Cookies are used for the following purposes:

• Maintaining the user’s session (after logging in), so the user does not need to re-enter their username and password on each page of the website;
• Achieving the goals specified above in the “Important Marketing Techniques” section.

The website uses two main types of cookies: “session” cookies and “persistent” cookies. “Session” cookies are temporary files that are stored on the User’s end device until they log out, leave the website, or close the software (web browser). “Persistent” cookies are stored on the User’s end device for a time specified in the cookies’ parameters or until the User deletes them.

Cookies placed on the end device of the User may also be used by entities cooperating with the website operator, particularly companies such as Google (Google LLC, based in the USA), Meta (formerly Facebook, Meta Inc., based in the USA), Twitter (Twitter Inc., based in the USA) and Microsoft (Microsoft Corporation, based in the USA).

9. MANAGING COOKIES – HOW TO GIVE AND WITHDRAW CONSENT IN PRACTICE?

1. If the user does not wish to receive cookies, they can change the browser settings. Please note that disabling the necessary cookies for authentication, security, and maintaining user preferences may hinder, and in extreme cases, may prevent the use of the website.

10. INTERNAL APPLICATION AND DATA FROM GOOGLE SERVICES

The operator uses its own application “Fabryka Neonów” (a Google Cloud project) solely to manage the company’s own accounts in Google services: Google Ads, Google Search Console, Google Analytics and Google Business Profile. The application does not access data from the Google accounts of Website users and does not ask them to sign in. Information received from Google APIs is used solely for reporting and for managing the operator’s accounts, is stored on the operator’s servers, and is neither shared with third parties nor used for advertising purposes. The use of information received from Google APIs adheres to the Google API Services User Data Policy (https://developers.google.com/terms/api-services-user-data-policy), including the Limited Use requirements.
